What does professional indemnity insurance cover?

Professional indemnity (PI) is the cover that responds when a client says your advice, design or service cost them money. Here's what it actually pays for, what it doesn't, and who needs it.

The core cover: negligence and financial loss

PI covers claims that your professional work caused a client a financial loss: negligent advice, errors and omissions, incorrect designs or specifications, and breach of professional duty. It pays your legal defence costs — which often dwarf the compensation itself — and any damages or settlement you're liable for, up to the policy limit.

Most policies also pick up related exposures: breach of confidentiality, defamation, loss of documents, unintentional intellectual property infringement, and dishonesty of employees. The exact list varies by insurer and profession, which is why the wording matters as much as the price.

What it doesn't cover

PI covers financial loss, not physical damage or injury — that's public liability. It won't cover deliberate wrongdoing, fines, contractual guarantees you've signed beyond your common-law duty, or claims you already knew about when you took the policy out. And because PI works on a "claims-made" basis, the policy that responds is the one in force when the claim is made — not when the work was done. Letting cover lapse, even after you stop trading, can leave old work uninsured.

Who needs it

If clients pay for your judgement, you probably need PI. That includes:

  • Consultants, IT contractors and freelancers whose clients' contracts require it — often £1m or more.
  • Architects, engineers and surveyors, where design errors surface years later at enormous cost.
  • Accountants, financial advisers and other regulated professionals, for whom it's compulsory.
  • Designers, marketers and recruiters, where a failed campaign or a bad placement becomes a negligence claim.

Why a specialist PI broker matters

PI wordings differ more between insurers than almost any other class: retroactive dates, "claims arising from" exclusions, cyber overlaps, collateral warranties, aggregation clauses. Two policies at the same price can respond completely differently to the same claim. A specialist professional indemnity insurance broker reads those wordings for a living, knows which markets write your profession well, and negotiates run-off cover when you retire or close — which is when many claims actually arrive.

Common questions

What does professional indemnity insurance actually cover?
It covers your legal defence costs and any compensation when a client claims your professional advice, design, specification or service caused them a financial loss — negligence, errors and omissions, breach of professional duty, and often defamation, breach of confidentiality and lost documents.
What's the difference between professional indemnity and public liability?
Public liability covers physical injury and property damage to third parties. Professional indemnity covers purely financial losses caused by your advice or work product. A consultant whose advice loses a client £500,000 needs PI; public liability would not respond at all.
Who needs professional indemnity insurance in the UK?
Anyone who gives advice, designs, or provides professional services: consultants, architects, engineers, IT contractors, accountants, designers, surveyors, marketing agencies and recruiters. Many professional bodies and client contracts require it — often at a specified limit — before you can practise or start work.
Is professional indemnity insurance a legal requirement?
Not by statute for most professions, but it is compulsory for some regulated ones (solicitors, accountants, financial advisers, insurance brokers) and is a contractual requirement in most professional supply chains. For practical purposes, many professionals cannot work without it.
